There has been an interesting phenomenon in the crypto world over the past two years: regulatory topics always revolve around the United States. Whenever the SEC takes action, the market is shaken three times. But from a different perspective, instead of repeatedly testing the ambiguous legal boundaries there, it’s better to look at the well-laid paths already paved in Europe.



The EU’s MiCA regulation has actually clarified the regulatory framework for crypto assets. Unlike U.S. regulators sending out subpoenas worldwide and repeatedly changing their stance on token compliance, Europe’s legal environment is more certain — which means something very different for infrastructure projects.

Take Dusk, a Dutch public chain, as an example. Its approach is quite interesting. Instead of chasing U.S. regulatory hotspots, it focuses on deepening its presence in the European market. When designing its underlying architecture, the project basically aligned with the provisions of MiCA. In other words, while other projects are still struggling with lawyers to argue “my token is not a security,” Dusk already has a technically compliant framework that naturally meets EU regulatory standards — asset issuers can directly use this code framework to conduct their business.

This geopolitical compliance advantage may seem insignificant, but for institutional investors, the value of legal certainty far exceeds technical performance improvements. Especially now, as the RWA (Real-World Asset on-chain) track becomes increasingly popular, those who can provide compliant and reliable infrastructure will have the opportunity to overtake on the curve. In markets with clear rules, building compliant infrastructure is much more reliable than trying to navigate uncertain waters.

It's another argument that "European regulation is clearer than in the US." While there's some truth to it, what’s often overlooked is that clearer rules also mean more controllable risks, allowing institutions to enter the market. Dusk's move is indeed clever; while others are betting on whether the SEC will change its stance, they have already laid out the infrastructure that can be directly used. Only after RWA gains popularity can this difference be truly seen.
