According to a House Agriculture Committee hearing on Tuesday, lawmakers are considering Congress's role in overseeing sports betting prediction markets amid ongoing conflicts between the Commodity Futures Trading Commission and states over regulatory jurisdiction. During the digital assets subcommittee hearing, representatives questioned whether existing laws and the CFTC's current resources are adequate to oversee the rapidly growing sector. Prediction market platforms Kalshi and Polymarket are now valued at roughly $22 billion and $15 billion, respectively, while the CFTC in March launched a rulemaking process for a broader regulatory framework.
Concerns about the CFTC's capacity dominated discussions. For fiscal year 2027, the CFTC requested a budget of $410 million, a 12.3% increase, compared to the SEC's $1.908 billion request. The CFTC has approximately 550 employees versus over 4,000 at the SEC. Rep. Austin Scott noted that expanding the agency's responsibilities without expanding capacity risks leaving critical oversight gaps. Rep. Glenn Thompson stated the committee will consider legislation if authority gaps are found.
