According to a Munich regional court ruling this week, Google must bear direct legal responsibility for misinformation generated by its AI Overviews feature. The court issued a preliminary injunction against Google after the AI tool incorrectly linked two legitimate Munich publishers to fraud, subscription traps, and suspicious business practices in search results.
The court distinguished AI-generated content from traditional search results, ruling that while search engines typically enjoy legal protection for linking to third-party pages, AI Overviews integrates and synthesizes information to produce substantive statements in Google's own words. The court determined these statements constitute Google's own speech rather than neutral search information, making Google directly liable for accuracy. Google argued users can verify information by clicking source links, but the court rejected this defense, stating the feature presents content as complete answers, and cannot be exempted from responsibility for misleading information.
